On
behalf of NREU, I have been representing before your good self for payment of
PLB of Railwaymen of SWR through bank. I reproduce the contents of
one of my representations for easy reference.
1. Apparently
99% of the employees of SWR are drawing their salary through bank payment.
Therefore absolutely there can be no hassles in arranging Bonus-2011 through
banks as bonus can be arranged through bearer cheque for those who do not draw
their through Banks.
2. The
PF-advance, DA arrears and NDA arrears are presently made through bank. Hence
Bonus also shall be arranged through Banks.
3. The
payment of Bonus through Cashiers involves avoidable exchequers’ loss in the
form of honorarium to the cashiers, payment of TA for the cashiers and the RPF
staff who accompany them.
4. Wastage
of man power arising out of grant of SCL to the recognized organization members
during bonus payment also can be avoided.
5. The
transaction arising out of drawing huge sum of money from RB to Railway Cash
Office to effect the bonus payment can be avoided. Likewise the quantum of
financial loss caused in drawing the cash from RB and securing the same in
Railway Cash Office also can be avoided. Further the man power lost in the
wasteful man oeuvre also can be curbed.
6. Payment
through cashiers is most unwanted and mindless. It involves so many maneuvers
like sending cashiers to Reserve Bank along with RPF personnel to draw the
money and bringing it to Railway Cash Office. Then handing over the cash to
dozens of Cashiers to distribute among the staff who will be working at
stations and work spots hundreds of miles away from the head quarters like UBL,
MYS and SBC. The cashiers are required to be provided RPF personnel as
security. If the cashiers travel by Passenger trains the trains need extra
stopping at all the stations causing inconvenience to the passengers. If the
cash is handed over to the SMs then the Pay clerks have to travel to the
stations to collect the pay sheets.
ALL THE ABOVE REDICULOUS MONEUVRES CAN BE
NIPPED IF PAYMENT IS MADE THROUGH BANK PAYMENT.
7. STAFF
SIDE: SAFETY AT STAKE.
7.1. Coming to the staff side, let
us look at the pathetic condition of SAFETY CATEGORY STAFF.
Let me first look at the open line
safety category staff like SMs, Points Men, Gate Men, Cabin Men etc.
a) The
staff who are not on duty have to come to station or gate or depot foregoing
their rest. Especially for those staff who have done night duty or due for
night duty it is nothing but harassment. They have to wait indefinitely to take
the Bonus. And to make things worse they will not be able to avail rest to
perform the night duty, thereby the safety in train operation is jeopardized.
b) It
is equally bad for the most important Loco Running staff. The Loco Pilots have
to forego their most precious Head Quarters Rest hours or PR to take their
Bonus. This is ridiculous when the Bonus can be arranged through banks.
c) Shri. M.C.SRIVATSAVA-(MT/RB) in
his D.O. bearing NO. 2002/Safety (A&R)/26/5 dated 11.2.2003 addressed to
all COMs & CSOs wonders whether it is humanly
possible for the Station Masters to handle all assigned duties,
faithfully, according to the spirit of the prescribed procedure due to ever
increasing work load on SMs. Therefore it is highly unwise to ask them to
disburse the Bonus handed over to them by Cashiers.
8. A
stage has come where it is prudent to disburse the Bonus payment through Banks
and the precedence is every much there as all payments including PF Advance, DA
arrears and NDA arrears are effected only through Bank. Perhaps
there is every chance that Recognized Organizations may request for payment
through cashiers so that they can force the employees to pay donations or
subscriptions. But it cannot be accepted as Bank payment has become the mode of
disbursement of the dues to the employees. In such an event the authorities can
concede their demand if the federations produce specific individual
representation from the employees who opt for payment of bonus through
cashiers as the stipulated procedure for payment of the employees’
dues is through banks and not through cashiers.
The above representation was submitted during September 2011 and when no
remedial actions were forthcoming to our satisfaction, a Civil Writ Petition
was filed by me through my counsel in the Hon'ble‘ HIGH COURT OF
DELHI AT NEW DELHI (Extra-ordinary Civil Writ Jurisdiction)’ bearing case
No.W.P(Civil)NO. 6052. The case came before the Hon’ble court on 24.09.2012 and
Hon’ble Mr.Justice SURESH KAIT passed an order the same day. While I happen to
be the Petitioner representing NREU in the instant case, the respondents are
(1) UOI through Minister of Railways (2) CRB/RB and (3) Ministry of Finance
represented through its Secretary.
The Hon’ble court in Para 3 has
directed the respondents to take decision on our previous representation within
6 weeks.
I make it a point to attach the
court orders for your kind attention.
In
the light of the above, I humbly submit that Your kind self may look into the
matter and initiate appropriate actions to disburse PLB 2012 through bank to
all employees of SWR.

Sub : Problem faced by GDR and TXR Staff at VSG/MPT yard
Respected Sir,
This UNION would like to bring to your kind notice that hardships faced
by GDR while clearing trains from Vasco da gama, and seeks your kind
intervention for an early solution.
At Vasco yard there is no pathway or
space for the GDR to walk between the tracks, since all the area other than
tracks are covered by thick grass or dumped garbage’s. GDR have to walk by sliding
over the ballast or walk close to the wagon by catching hold of them. Added to
this there are a number of uncovered manholes between tracks which becomes
invisible during rail due to flooding. The presence of poisonous snakes and
scattered broken glass pieces make
is extremely dangerous to move
particularly during night. Lighting arrangements are very poor.
At MPT yard Rd-1 is not accessible on
one side due to presence of security wall and dangerous on the other side to
walk due to deep troughs. Earlier only empty rakes were placed there, now
loaded placing rakes on Rd-1 and GDR were forced to clear it. This is hazardous
for the crew due to presence of snakes.
We request your good office to intervene
urgently and solve the problem.

As the vide reference No.(1) & (2) the hon’ble Railway Board had been issued order to control the Out Station Detention of
Running staff for the time to time . In
those days where traffic are less and no frequent train
service exist ,bringing the crew back to
headquarters was not so easy within
a period of a day or two. But the
position has considerably changed. Realizing the position the Railway Board
pleased to issued its second order directing to the Railway management to bring
back the Running staff to Headquarters within 36 hrs where ever it is feasible,
as vide

But
unfortunately the records pertaining to in this regards clearly alarming the
condition of the running staff in the outstation as dark. This union hereby
submitting the CMS / CRIS downloaded details for month of March along with this
representation for your kind perusal and necessary action please.
It is understood that, the Hubli divisional
authorities of traffic and mechanical department not have any interest to
follow the order partially also.
This union strongly solicits your immediate
intervention in this regard and requests your august office to direct the Hubli
divisional authorities to reduce the headquarters absence to 36 hrs for the
better family life.

Dear Railwaymen,
NREU wishes a great and happy MAY DAY for
the ‘NATION’S ECONOMY BUILDERS OF GREAT INDIA’, that is you, the Railway
Workers and your family members.
MAY DAY, perhaps, is the only UNIVERSAL DAY
though it is celebrated in different names like INTRNATIONAL WORKERS’ DAY,
LABOUR DAY , WORKERS’ DAY etc. We can
say, almost entire world celebrates this day. Approximately 80 countries have
declared first of May as NATIONAL HOLIDAY including India.
The entire world celebrates MAY DAY on
first of May to sing the greatness of WORKERS and also in commemoration of the 1886 Haymarket Massacre in Chicago. The workers
of Chicago had gone on a strike DEMANDING EIGHT HOURS OF WORKING HOURS per day
and had arranged a meeting on the fateful day. The police opened fire when an
unidentified person had thrown dynamite at the police. The sad episode resulted
in the death of several workers and police officers as well.
In
India, the FIRST MAY DAY was organized in Madras (now, Chennai) on May
First 1923 by Kisan Party. The RED FLAG fluttered and danced in the air for the
first time in India on this unforgettable day.

1. The Divisional Operations Manager DID NOT comply with RB guide lines and FAILED TO POST ADDITIONAL ASM AT PENUKONDA STATION.
The Joint Procedural Order issued Shri. Sri.V.K.Roy, E.D (Traffic Transportation), and Sri. Mahesh Kumar, ED (Signal) of the Railway Board vide their circular bearing NO. 2002/Sig/P1/1 dt. 09.07.2002 stipulate that if the line capacity utilization (MEANING DENSITY OF TRAFFIC) has reached 85% an Additional ASM/Group ‘C’ traffic shall be provided in ach shift for doing multifarious work carried out by the Station Master.
The shocking revelation is that the DENSITY OF TRAFFIC at Penukonda station is 145.13% towards Yelahanka on the one direction and 110.3% towards Dharmavaram on the other direction. But the Divisional Operations Manager (DOM) who is empowered to take a decision to post Additional Station Master failed to take a decision in time and did not post Additional Station Master RESULTING IN THE DEATH OF 26 INNOCENT PASSENGERS. Due to the non implementation of the Railway Board Order even after one decade only one SM was working at Penukonda at the time of accident.
Thus the SM was performing TWO STATION MASTES’ DUTY and working under tremendous pressure. and it was very much required to post Additional ASM at PKD. But no Additional ASM was posted to Penukonda at the time. This is one of the prime reasons for the accident. The letter under reference was issued in the year 2002 and even after one decade no concrete steps were taken to ameliorate the issue. In the adjacent Southern Railway a large number of Additional ASM posts have been created. But in Bangalore Division and in South Western Railway NO CONCIOUS EFFORTS WERE MADE to post Additional Station Masters till date.
2. The Divisional Operations Manager did not post a SUPEVISOR GRADE STATION MASTER WITH SUFFICINT SERIVCE to Penukonda as INCHARAGE STATION MASTER since May 2011 though IT IS A JUNCTION.
It is a convention and time tested PROCEDURE followed in Indian Railways to post a SENIOR STATION MASTER WITH SUFFICIENT SERVICEE TO BE IN CHARGE of JUNCTION STATIONS.
Penukonda is a Junction with trains running in THREE DIFFERENT DIRECTIONS-towards Bangalore City , towards Secunderabad and Sri Sai Sathya Nilayam (that is Puttapparthi). Till May 2011 one Shri.Raja Rao in the status of STATION MASTER GRADE ONE with 33 YEARS OF SERVICE was working as INCHARGE Station Master. But he was transferred to Hindupur during May 2011 and EVER SINCE ONE SHRI.SRINIVASA RAO was ordered to be in charge of Penukonda. The Station Master is a inexperienced with hardly seven years of service. And just two months back the DOM has posted one a Station Master in the status of Station Master Grade one who has put in less than 10 years of service in Railways.
THUS A MAJOR JUNCTION STATION WAS LEFT TO THE CARE OF INEXPERIENCED STATION MASTERS WITH LESS THAN TEN YEARS OF SERVICE AS STATION MASTER IN CHARGE CULMINATING IN THE ACCIDENT AND THE DEATH OF 26 PASSENGERS.
NOT POSTING A SENIOR STATION MASTER WITH SUFFICIENT SERVIDCE IN THE STATUS OF SM GRADE ONE IS a serious administrative lapse committed by Divisional Operations Manager causing the major calamity.
3. NOT DEPUTING BOOKING CLERK TO ISSUE TICKETS IN THE NIGHT SHIFT FOR THE MUSLIM ANNUAL URS (FESTIVAL/JATHRA) BY DIVISIONAL COMMERCIAL MANAGER LED TO THE ACCIDENT.
“The roadside station staff performing simultaneous, operating and commercial duties get highly stressed due to role overload, role conflict and unreasonable pressure.”
The current accident was WELL ENUMERATED and DEFINED by Shri. Vinesh Kumar (Executive Director/Traffic) in his circular bearing No.2002/TG/V/IO/ PA/110/CRS BC Dt.24.05.2004. The term that has relevance is ‘ROLE CONFLICT’ which means doing conflicting duties at a time simultaneously. The accident could have been prevented despite the Loco Pilot passing the signal at danger had the SM/s attention WAS NOT DIVERTED IN ISSUING TICKETS AND ANSWERING THE QUERIRS OF THE HUNDREDS OF PILGRIMS.
Though the actual number of tickets were not much at the material time there were hundred of passengers in the waiting hall adjunct continuously distracting with their queries.
NOT DELEGATING A COMMERCIAL CLERK TO HANDLE THE FAMOUS ANNUAL MUSLIM URS DEVOTEES DURING THE NIGHT TIME WAS A MAJOR CAUSE FOR THE ACCIDENT UNLIKE THE PREVIOUS YEAR WHEN A COMMERCIAL CLERK WAS DELEGATED TO WORK IN THE NIGHT SHIFT IN THE TICKET BOOKING COUNTER.
The distraction caused by the pilgrims resulted in loss of concentration on the part of the SM and he did not alter leading to a free line with the result Humpi Express rammed into the stabled goods train on Road 2 when the Loco Pilot of 16591 passed the Home signal of Penukonda at danger.
The SM did not receive Humpi straight to Road 3 (that is Platform No.2) though it was free and he planned to receive it on Platform NO.1 after the departure of 165953 express.
Penukonda has two passenger platforms divided by one goods line that does not have a platform for passengers since it is meant only for receiving Goods trains. When such situations arise where two platform lines are separated by a goods line to facilitate the passengers to traverse from one platform to the other it is essential as an amenity and safety measures to provide a Foot Over Bridge . Though there was provision for a FOB in the construction plan the FOB was not at built at Penuknoda. Earlier on a few occasions passengers had made complaints on the SM on duty whenever the trains were received on Platform No.2 More over on that day the in between line was occupied by the Goods train and absolutely there was no way for the passengers to come to Platform Number one side to go to town.
Because the FOB was not built by DIVISIONAL ENGINEER (CONSTRUCTION) the SM was not inclined to signal the Humpi Express to Platform No.2 which was free and THEREFORE NOT PROVIDING FOB IS ONE BASIC CAUSE OF ACCIDENT. More over due to festival more children and women passengers were expected by the train and the SM did not want to earn the wrath of the pilgrims/devotees.
THUS NON CONSTRUCTION OF A FOB IS AN IMPORTANT CAUSE FOR THE ACCIDENT.
On par with Para 4 is THE NON PROVISION OF ELECTICAL LIGHTS ON ROAD 3/PLATFORM NO.2 was another important reason that made the SM panicky to receive Humpi Express on Platform No.2 without detaining it in the Home signal since lot of children and women pilgrims were coming from all directions for the ANNUAL MUSLIM FESTIVAL and the non provision of lighting on Platform No.2 was a dreaded factor and a major cause of the accident. Consequently many times robbery had taken place whenever trains were dealt on Rd.3/Platform No.2. Already there are complaints against the SMs for receiving Passenger carrying trains on Platform No.2
A serious factor that shall not be lost sight is the fact that 24 out of the 26 causality WAS CONSEQUNT ON BURN INJURIES AND NOT DUE TO DIRECT INJURY ARISING OUT OF COLLISSION.
Thus only two died due to the collision and heavy causality could have been not there at all if the fire hadn’t broken out due to the spilt petrol from the two wheelers loaded in the luggage compartment.
The causality rose high due not decanting the petrol before loading the two wheelers and this is the major cause of causalities being on the higher side. This deserves special attention of the media since the lives of 24 innocent passengers could have been prevented if two wheelers with petrol hadn’t been loaded in the luggage portion of the SLR.

Sir,
1. Filling
up vacancies in higher grade.
Another
Cadre Restructuring is round the corner and to ensure the benefits reaches
every railway employee it is paramount to fill up the vacancies in higher
scales/GP first before implementation of the anticipated Cadre Restructuring.
Otherwise the purpose and the concept of Cadre Restructuring will be washed
out. Hence this organization requests your kind self to issue appropriate
orders to fill up the vacancies in higher scales/GP on war footing.
1.1: While the above proposal is common to all
categories, it is requested that such filling up vacancies/promotions in safety
categories shall be given urgent attention.
2. Issue
of Personal Safety Requirements.
Employees/workers
are not issued personal safety requirements like boots, gloves, helmets etc.
Kindly issue suitable orders to workshop executives and others concerned.
3. Medical
woes
The
medical department needs urgent pulling up. Supply of medicines and treatment
in the RHUs are not up to the mark and patients are put to lot of hardship.
4. Multi-skilled
shall not end up multi-killed.
In MYS
division PRS are planned to be opened in five stations and SMs have been
advised to operate the proposed Reservation offices over and above their normal
‘Train Operation Duties’. It is a safety hazard and any such move may be halted
forthwith. ‘Multi-skilled shall not end
up as the cause to endanger public safety. If the authorities are very
particular that the residents of the proposed stations deserve PRS it shall be
done duly posting ECRCs and CRS.
5. Infringing
rights to allowances.
It is
becoming almost a regular future that NDA, OTA and TA are withheld on the plea
of inadequate funds. This organization is not able to see any logic in denying
the said allowances. Therefore it is requested that the allowances shall be paid
along with salary without fail.
6. Accommodation
for NREU.
This
organization also requests your kind self to advise DRMS of UBL, SBC and MYS to
allot space/ accommodation for this organization at UBL, SBC and MYS to open
our union offices (duly fixing nominal rent etc.)
7. Embarrassment/Woes of women workers.
Provide
staff room for ladies with adequate facilities. A large number of women
employees are there in Indian Railways, thanks to the Government’s policy of
‘empowering women’ by providing them jobs in Government. But let alone adequate
amenities, in many units/work spots EVEN BASIC AMENITIES like toilets and
drinking water are not provided. You are requested to call for information from
units/work spots and issue suitable orders to ameliorate this embarrassment/problem
faced by women employees in SWR.
8. Problems
in proceeding on duty without accommodation.
Allocate
sufficient berths in specific trains, normally by which staff proceed on
official normal duties and emergency duties. (to cite an example Rani
Channamma). It is brought to this organization that staff face lot of hardship
when they are advised to proceed on duty without any reservation of berths. By
maintaining certain number of quota of berths by specific trains on all
directions this problem can be addressed.
8.1: As
a consequence it is requested that suitable accommodation facilities may be
allocated at the other end (like UBL, MYS, SBC) for stay of the staff on
official duties. At present they are at compulsions to utilize the waiting room
facilities which is not advisable.
Availing
this opportunity we wish to state that this organization will extend our
support for the smooth functioning of the SWR even as we wish you a successful

SWR Mazdoor Union criticisedfor ‘assaulting' NREU members
Respect the democratic rights of other trade unions: NREU
Scores of employees of the South Western Railway took out a protest march in Hubli on Monday condemned the assault on some railway employees allegedly by office-bearers of the SWR Mazdoor Union.
Commencing from the Hubli railway station, the railway employees marched to the office of the General Manager of South Western Railway under the aegis of Nairuthya Railway Employees' Union (NREU) holding placards and banners condemning “intimidating behaviour” of some trade union leaders.
The protesters said that NREU was a registered trade union under the Trade Unions Act and as a registered trade union it had its democratic rights under the law of the land. However, a few office-bearers of the SWR Mazdoor Union were trying to prevent the NREU members from creating awareness among the railway employees about their rights.
President of the NREU S. Prasannakumar and working president T. Sabu, and district secretary of CITU Mahesh Pattar led the protest march. They then staged a demonstration in front of the General Manager's office.
Addressing the protesters, the NREU leaders condemned the attack on NREU office-bearers in Hubli on April 28. They said that the NREU office-bearers were prevented from speaking to workers.
Later, SWRMU office-bearer A.M. D'cruz and his followers attacked them and they were released by the mob only after the Assistant Security Commissioner of the Railway Protection Force intervened.
They urged the SWRMU leaders to respect the democratic rights of others. They submitted a memorandum to the SWR authorities.
