Subject:   Recommendations of the Committee of Experts on Disciplinary & Vigilance Inquiries (Hota Committee) – Para 135 of the Committee’s Report on submission of draft charge sheet while seeking first stage advice of CVC, etc. – Acceptance by Government – reg .
The undersigned is directed to say that the Government had appointed a Committee of Experts to review the procedure for Disciplinary/Vigilance Inquiries and recommend measures for their expeditious disposal. The Committee comprised the following:
(i) Shri P.C. Hota, Former Chairman, UPSC Chairman
    (ii) Shri Arvind Varma, Former Secretary, DoPT Member
(iii) Shri P. Shankar, former CVC Member.
2. The Expert Committee has, in para 135 of its Report, made the following recommendation:-
“135.(a)We have noted that even after approval of the Disciplinary Authority to initiate a Disciplinary Inquity, a lot of time is taken by the Department/Ministry to frame the Articles of Charge against a delinquent Government Servant.
(b)  We recommend that to eliminate delays in framing the Articles of Charge, the official file submitted to the Disciplinary Authority to initiate a Departmental Inquiry must have a copy of the draft Articles of Charge along with the imputations in support and a list of witnesses and documents. Such action before approval of the Disciplinary Authority is obtained to initiate a Departmental Inquiry against a delinquent Government Servant, would ensure timely framing and service of the Articles of Charge. We also recommend that when a case is sent to the CVC for its first stage advice, the Articles of Charge, complete in all respects, must be submitted to the CVC.
3. The aforesaid recommendation of the Hota Committee was considered by a Committee of Secretaries (CoS) under the chairmanship of Cabinet Secretary. The CoS has recommended acceptance of the aforesaid recommendation. Accordingly, the above recommendation of the Hota Committee has been accepted by the Government and it has been decided that all Ministries/Departments shall henceforth ensure that whenever a disciplinary case file is submitted to the Disciplinary Authority, seeking the approval of the Disciplinary Authority for initiation ofdepartmental proceedings against a government servant, a draft of the articles of charge, complete in all respects, along with the imputations in support and the list of witnesses and documents, shall be submitted to the Disciplinary Authority for its consideration. Similarly, whenever a case is referred to the Central Vigilance Commission for its first stage advice, a draft of the articles of charge, complete in an respects, as proposed by the Ministry/Department, shall be submitted to the CVC for its consideration.
4.  The above decision of the Government is brought to the notice of all Ministries/Departments for strict compliance.

       However Railways/PUs may procure the items as per DGS & D Rate contract specifications , which has all the essential features as an alternative ti BIS specification upto December 2013 till when the product is expected o be available in market exclusively as per BIS
        This issue is consultation with Finance, Civil Engineering, & Stores Directrats of the Ministry of Railways .

Sub: High court judgment dated 24.09.2012 in WP(C) No.6052/2012 filed   by Nairuthya Railway  Employees Union before High Court of Delhi.
                                                                                                                         

      The Hon’ble High Court of Delhi in the above judgment has directed this Ministry to decide the representation dt. 30.8.2011 from Nairuthya Railways Employees Union (NREU)/HUBLI.

2. The said representations have been considered by Chairman, Railway Board. The representationist has made a case for payment of PLB for the year 2011 through Bank. In this representation it is stated that, sanction orders for payment of PLB for financial year 2011-12, were issued after taking into consideration the representations received from various employees associations, including those from Nairuthya Railways Employees Union, as well as the views of the administration on the issue of mode of payment of PLB. Accordingly PLB order dated 18.10.2012 were issued instructing the Railways to make the payment of PLB on priority in the same mode as salary. A copy of the Railway Board’s letter No.E (P&A) II -2012/PLB -4 dt. 18.10.2012 is enclosed herewith.

3. The issue raised by NREU/Hubli, having been already considered before the issue of PLB sanction under for the 2011-2012, the representations of NREU/Hubli dated 30.8.2011 and 23.09.2011 stand disposed.

               Subject :  Payment of Productivity Linked Bonus to all eligible non-gazette      
                                 employees for the financial year 2011-2012.

         The President is pleased to sanction Productivity Linked Bonus ( PLB ) equivalent to 78 ( Seventy Eight ) days  wages without any ceiling on wages for eligibility for the financial year 2011-12 to all eligible non- gazetted Railway employees ( excluding all RPF/ RPSF personnel )  . Where wages exceed Rs. 3500/- per month, Productivity Linked Bonus will be calculated as if 'wages' are Rs. 3500 /-  p.m.

2.    'Wages' for the purpose of calculating Productivity Linked Bonus shall include 'Basic pay' as defined in the Railway Services ( Revised Pay ) Rules, 2008 and dearness allowance drawn during the financial year 2011-12. Other condition of eligibility, method of calculating wages,etc, as prescribed in the Ministry instructions and classifications issued from time to time \, shall remain unchanged .

3.       It has also decided that in the case of eligible employees mentioned in Para 1 above who were not placed under suspension , or had not quit service /retired/expired during the financial year 2011-12 or were on leave where leave salary admissible is less than  that admissible on leave on average pay , may be paid an amount of Rs.8975/- towards Productivity Linked Bonus for the financial year 2011-12 . In the case of employees other than those mentioned in the above , the amount of Productivity Linked Bonus may be calculated in accordance with the extant instructions on the subject.

4.       Further , in relaxation to the provisions in the Rules 905(2), 908 and 909 of State Provident Fund Rules, as contained in Chapter 9 of R-1/1985 edition  (2003 Reprint edition , such of the subscriber to the SRPF as are entitled to Productivity Linked Bonus may, if they so desire, deposit the whole or part of the amount admissible under the Scheme in their respective State Railway Provident Fund Accounts .

5.         Disbursement of Productivity Linked Bonus for the finacial year 2011-12 to all eligible non-gazetted Railway employes mentioned in Para 1 above should be made on priority and may paid in Cas/ECS as per  the salary mode before the ensuring Puja/Dussehra holidays .

Subject: Restructuring/Reorganisation of Staffing pattern ofTrackmen on Indian Railways.
 
The issue of career progression and working conditions of Trackmen on Railways has regularly been raised at various fora from time to time inthe past through both the recognized Federations. Accordingly, a Joint Committee comprising of representatives of both the recognized Federations and Senior Administrative Grade Officers (SAG) of Railway Board was constituted to consider career progression of Trackmen alongwith review of their existing channel of promotion etc. Ministry of Railways (Railway Board) have considered the report of the Committee and decided that the existing categories of Trackmen/Gatemen/Trolleymen/
Watchmen/Keymen in PB-1, Grade Pay Rs. 1800 and Mates(P.Way) in PB- 1, Grade Pay Rs. 1900 in the Permanent Way side of Civil Engineering Deptt. of Indian Railways will henceforth, be operated as a unified cadre of Track Maintainer as per the following pattern :
 
(i) The categories of Trackman/Trolleyman/Gateman/Watchman/ Keyman in Civil Engineering Department (P.Way) in PB-1, Grade Pay Rs. 1800 be clubbed and given the designation of Track Maintainer Grade-IV (PB-1, Grade Pay Rs. 1800);
 

(ii) The Mates(P.Way) in PB-1, Grade Pay Rs. 1900 may be re-desiganated as Track Maintainer Grade III (PB-1, Grade Pay Rs.1900). This would be the next level of promotion for TrackMaintainer Grade-IV.;
 
(iii) Posts in PB-1, Grade Pay Rs. 2400 of unified cadre of Track Maintainer to be filled from eligible staff from the next lower Grade Pay of Track Maintainer category based on seniority cum suitability and may be designated as Track Maintainer Grade II;
 
(iv) Posts in PB-1, Grade Pay Rs. 2800 of unified cadre of Track Maintainer to be filled from eligible staff from the next lower Grade Pay of Track Maintainer category based on selection and may be designated as Track Maintainer Grade-I.

1.1 Accordingly, revised structure of unified cadre of Track Maintainer would be as under:-

4. The above revised pattern of unified cadre of Track Maintainer will be effective from the date of issue of these orders.
 
5. This has the sanction of the President & issues in consultation with Establishment Directorate and with the concurrence of Finance Directorate of the Ministry of Railways.

 Cashless medical Treatment for Retired Railway Employees

Sub:      Cashless Service for RELHS Card Holder to take treatment in Recognized Private   

               Hospitals in emergency.




        In an endeavour to alleviate the problems faced by the Sr. Citizens in getting treatment in emergency, a cashless service for RELHS card holdersto take treatment in recognized private hospitals of National Capital Region was introduced by Northern Railway vide Board’s letter of even no. dated 29.02.2008 as a Pilot Project. The scheme was subsequently extended by one year each on two occasions i.e. up to 20.08.2011 vide Board’s letters of even no. dated 13.11.2009 and 27.01.2011.
       The issue of extension of the scheme or otherwise was under consideration in the Ministry of Railways for sometime. The Competent Authority in the Ministry of Railways after careful consideration in the matter, has decided to extend the facility till further orders for RELHS beneficiaries to take care of their health care needs in an acute emergency. This scheme will now be available in all Metros, State Capitals and Zonal Headquarters of the Indian Railways. Detailed guidelines on the subject attached.
         This issues with the concurrence of Finance Directorate in the Ministry of Railways.

Terms & Conditions of the Scheme
I.    The scheme is to be implemented in all the Metros, State Capitals and Zonal Headquarters.
II.    Zonal Railways shall enter into an ‘MOU’ with already empanelled hospitals under their jurisdiction for the scheme. Further, if there are not enough recognize multi-specialty hospitals, zonal Railways shall recognize CGHS empanelled hospitals on CGHS approved rates and/or other hospitals as per extant policy and enter into an ‘MOU’ for the Smart Card Scheme.
III.    Smart card should provide necessary demographic data and other relevant information on a standardized format.
IV.    Zonal Railways shall award the job of issuing the Smart Card to a suitable services provider on most competitive rates, through open bidding.
V.    It shall be the responsibility of the hospital to inform the authorized medical attendant regarding emergency within 24 hours. In case an admission is found to be of non-emergency nature, the treating hospital shall refer the patient to authorized medical attendant in next 24 hours.
VI.    Issuance of smart Card is made mandatory to RELHS at the time of retirement.
VII.    The following conditions, shall qualify as emergencies.
  • Acute cardiac conditions/syndromes.
  • Vascular catastrophes, Cerbo-vascular accidents.
  • Acute respiratory emergencies.
  • Acute abdomen including acute obstetrical. gynaecological emergencies.
  • Life threatening injuries.
  • Acute poisoning and snake bite.
  • Acute endocrine emergencies.
  • Heat stroke and cold injuries of a life threatening nature.
  • Acute renal failure.
  • Severe infections leading to life threatening situations.
  • Any other condition in which delay could result in loss of life or limb.

      Ministry of Railway ( Railway Board ) have decided ti constitute an SAG level committee to examine and evaluate the demands /requests received in the State Government and varies ministers / MP's / MLA's ,etc for the creation of New Zonal / Division . The committee consist of the following :-

2.   The terms of  reference of the committee will be as under :-
               i). Analyze the requests / Demands received  from various State Government and  
                   Ministers / MP's / MLA's ,etc for the creation of New Zonal / Division, since 2009 ,
                    for the creation of New Zonal / Divisions, from the following angles:- 
                  
                  * Operational feasibility,
                  *  Financial implications,
                  * Administrative Issues ,
                  * Staff Matters & Industrial Relation (IR) Issues,
                  * Infrastructure availability & other requirments.
                 
                On  the basis of the above analyze , examine the feasibility   of creation of the 
                proposed Zones / Divisions accordingly  reorganization of existing Zones/ Divisions.
               
               ii). The committee may also consult the Zonal Railways in this regards.
               iii). The views of the Federations / Unions may be obtained for those proposal which
                       are found feasible.
3. The Headquarters of the committee will be at New Delhi.
4.  The committee should submit its report within a period of six month from the date of its  
    constitution.
5. The convener and members of the committee will be eligible to draw TA / DA as per the 
    existing rules.

Sub: Revised pay limits for entitlement of Passes/PTOs on the basis of Pay drawn in the Railway Services (Revised Pay) Rules, 2008.
Consequent upon revision of Pay Scales on the basis of decision of the Government on the recommendations of the 6th Central Pay Commission, the question of revision of existing entitlement of Passes/PTOs under the Railway Servants (Pass) Rules,1986 ( Second Edition,1993) has been under consideration of this Ministry.
  1. The matter has been examined and the President is pleased to decide that the entitlement of Passes/PTOs in respect of railway servants drawing pay in the Railway Services ( Revised Pay) Rules,2008 shall be as under:-

5.         Necessary amendment to the Railway Servants [Pass] Rules, 1986 [Second Edition, 1993] shall follow.
6.         This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Provision of subsidized meal/food to the running staff in Running Rooms

             Sub:    Provision of subsidized meal/food to the running staff in Running Rooms         
                                                 
               Consequent to the Budget announcement for providing food at nominal rates to the running staff in the running room, the issue of guidelines in this regard has been under consideration.  An EDs Committee was constituted by the Board to go into the difficulties being experienced by the running staff in arranging their food at odd hours during the course of their stay in running room and to make recommendations.  After considering the recommendations of the Committee, Board have taken the following decision:



  1. If the quality of contractor supplied food in running room is improved, then large number of existing staff who prefer food prepared from their personal ration are likely to switch over to contract meals.  Therefore, it has been decided that 90% cost of a meal supplied by the caterer or Rs.18 per meal including Tea, whichever is less, would be borne by railway administration.  This subsidy would be an attractive incentive to improve the quality of provision used in the preparation of food in the running room by contractors.  Therefore, necessary clauses may be incorporated in future contracts to the effect that 90% of the cost of meal or Rs.18 per meal whichever is  less, would be paid to the contractor by the railway administration as a subsidy.  Tariff for various menu items should be fixed taking into account this subsidy.
  2. To improve the quality of food, only reputed, branded and agmark certified  provision items should be allowed to be used in all such contracts. Stringent penalty should be imposed for non-compliance of these specifications.
  3. The present systems of free supply of LPG gas [used for cooking in running room], free furnishing of kitchen equipments/other kitchen infrastructure in running room should continue.
  4. While implementing the scheme, no additional expenditure is to be incurred on creation of posts.  However, financially self-sustained readjustments can be made as per need of new structure in due course of time.
  5. In case railways feel that it would be difficult to implement the above recommended scheme of making available meals at subsidized rates in departmentally managed running rooms, the services of such running rooms may be outsourced with the approval of DRM.
  6. Periodical supervision regarding the quality of meal at appropriate level and a six monthly audit of the accounts may be ensured.
  7. The tariff should be fixed after taking into account the subsidy and other free supply inputs as indicated in para C above.
  8. Even after the introduction of this scheme, if some staff prefer to have their personal ration cooked in the running room kitchen, then the same may be allowed but no subsidy would be involved in these cases.
This has the approval of President and issues with the concurrence of the Finance Directorate of the Ministry of Railways.

                            Instructions have been issued vide Board’s letter No. TCII/2910/06/Garib Rath dated 28-09-2006 [Commercial Circular No. 77 of 2006] regarding the basic fare structure and classes of travel available on Garib Rath Express trains.  The question of validity of Privilege Passes/PTOs and other passes for traveling in Garib Rath Express trains has been considered by Board and it has been decided that:
 [i]         All Passes/PTOs valid for travel in 1st Class A/AC-2/AC-3/Chair Car issued to Railway Servants /Retired Railway Servants /Individuals under Railway Servants [Pass] Rules, 1986 will be valid for travel in Garib Rath Express trains.  However facility of attendant will not be permitted on these trains.
 [ii]        Complimentary Card Passes issued to Freedom Fighters, Gallantry Awardees, Arjuna Awardees and other categories of Awardees based on instructions issued from time to time which are valid for travel in AC-3 tier will be valid for travel in Garib Rath Express trains.
 [iii]        The facility of rail travel being provided to Members of Parliament, Ex-MPs under Salary Allowances & Pension of Members of Parliament Act, 1954  for which debits are raised on the Lok Sabha /Rajya Sabha Secretariat will also be extended to Garib Rath Express trains.
 [iv]       Except for categories indicated at [i]   & [ii] above, the element of reservation fee, superfast surcharge and safety surcharge as indicated in Commercial Circular No.77 of 2006 will be included in the  reimbursement claim.
2.   This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
